High Court Overturns Cosase Probe against Beti Kamya

UGANDA, Kampala | Real Muloodi News | The High Court in Kampala has overturned the findings of Parliament’s Committee on Commissions, Statutory Authorities and State Enterprises (Cosase) regarding Inspector General of Government (IGG) Beti Kamya.

The committee had implicated Kamya, then Lands minister, and Finance Minister Matia Kasaija in an alleged USh10.6 billion dubious land compensation case.

However, the head of the Civil Division of the High Court, Justice Musa Ssekaana, declared that the process leading to the duo’s implication was flawed.

Justice Ssekaana issued an order quashing the recommendation made by Cosase, stating that Kamya should be investigated for her involvement in the commencement of the USh10.6 billion payments.

The judge concluded that the analysis and evaluation of evidence conducted by Cosase were flawed.

“The court issues an order of certiorari quashing recommendation (1) of the report; ‘Hon Beti Namisango Kamya Turwomwe, the former Minister of Lands, Housing and Urban Development should be investigated in respect to her participation in the commencement of the Shs10.6 billion payments,” ruled Justice Ssekaana.

Adding: “The same was reached through a flawed analysis and evaluation of evidence that she kicked off the supplementary budget process which is the role mandate and discretion of the Ministry of Finance, Planning and Economic Development. The application only succeeds on this ground and I make no order as to costs. I so order.”

However, the court rejected Kamya’s argument that the committee had failed to evaluate the evidence properly and denied her a fair hearing.

In his ruling, Justice Ssekaana affirmed that the investigations carried out by Cosase were legally conducted. Kamya had argued in her petition that the committee’s decision to investigate her involvement in initiating the supplementary expenditure process lacked a basis or supporting evidence.

Cosase, chaired by Nakawa East MP Joel Ssenyonyi, discovered that several landowners had been wrongfully compensated in different parts of the country, with some claims being fabricated.

The committee found that Kamya had erroneously initiated the supplementary budget for land compensation, a task that should have been carried out by the Uganda Land Commission (ULC).
