NSSF Battles with Four Individuals over Lubowa Land

UGANDA, Wakiso | Real Muloodi News | A battle for land ownership between the National Social Security Fund (NSSF) and four individuals in Lubowa has escalated.

The four individuals claiming ownership of the land in Lubowa are Muhammad Kityo, Moses Bogere, Betty Namanya and Daphine Nakanwagi, who have warned they will confront anybody who tries to forcibly seize or steal their land.

The land in contention is in Lubowa on block 269, plots 3234, 3235,3236,3237,3238,3239, and 3240, measuring over 186 acres. The contested land is also claimed by NSSF, and had been doubly registered as Block 269 plots 3234–3240 and Block 269 plot 1322.

True to their word, the four land owners filed a case against the Commissioner for Land Registration accusing him of illegally cancelling their titles.

The court stated that the Commissioner for Land Registration had no right to cancel the certificate of titles based on a forgery and therefore quashed his cancellation decision.

The court, which was presided over by Justice Musa Sekana, ruled in their favour and even ordered NSSF to compensate them for any damages and costs.

“In the premises, I find that the respondent had no right to cancel the applicant’s certificate of title based on forgery and I here grant this application with costs to the applicants,” Justice Sekana Musa’s ruling reads.

According to a memo from the Ministry of Lands dated 10/05/2021, Hon. Beti Kamya, who was the Minister of Lands at the time, instructed the acting Commissioner for Land Registration to follow the court’s order and the ruling on 20/12/2020 allowing Muhammad Kityo, Moses Bogere, Betty Namanya, and Daphine Nakanwagi to possess and freely enjoy their Lubowa land on plots 3234- 3240.

This will allow the latter to transact any lawful business of their choice on the subject land governed by the principle “justice delayed is justice denied.”

Hon Kamya added in the memo that she will be informing Col Edith Nakalema who is now the State Minister of Lands of these findings and her directive to comply with the Court order.

However, the four individual land owners have been informed that NSSF intends to launch the commissioning of their housing project on that same disputed land and they intend to invite His Excellency the President as the Chief Guest without them as part of the development.

“We have gotten intelligence information that NSSF is launching the commissioning of their housing project which was built on our land which they have not yet cleared, and they have called the President of this country to be the Chief Guest which is contrary to the court ruling and judgement that gave us powers on our land,” the four individuals complained.
