RDC to Face Disciplinary Action over Illegal Eviction

UGANDA, Wakiso | Real Muloodi News | The Makindye Ssabagabo Resident District Commissioner (RDC), Mark Baingana, is facing disciplinary action for his involvement in the illegal eviction of residents in Busabala, Wakiso District.

The press secretary for the Minister for the presidency, Steven Dunstan Busuulwa, confirmed this information.

In a phone interview, Mr Busuulwa said that the Minister for the presidency, Hon. Milly Babalanda ordered the secretary in the office of the President, Hajji Yunus Kakande to investigate the matter.

“Hajji Kakande immediately instituted a committee headed by Maj. Martha Asiimwe and Herbert Atuhairwe to investigate the RDC’s direct involvement in the eviction of some residents of Busabala without following the February 28th 2022 presidential directive on evictions,” Mr Busulwa explained.

The directive issued by President Museveni in February ordered that no land eviction should take place in any district without a District Security Committee meeting, chaired by the area deputy Resident District Commissioner in direct consultation with the Ministry of Lands.

The President warned that if evictions do take place without a District Security Committee meeting, all the members of the District Security Committee will face disciplinary action.

“After receiving the court order, the RDC is supposed to convene a district security meeting, authenticate the letter then write to the Minister of Lands for guidance before action is taken. Unfortunately, it’s said that Mr Baingana never followed any of those steps…the RDC has been summoned to face the committee,” Busuulwa said.

The press secretary added that the RDC, Mr Baingana also ordered the eviction without a court order.

Among the affected residents whose houses were destroyed during the eviction is the Kayunga District Local Council 5 Chairperson, Andrew Muwonge.

In a letter dated February 28, 2022, the president addressed the Prime Minister, Rt. Hon. Robinah Nabbanja using his powers and authority under Articles 98(1) and 99(1) of the constitution to fight against illegal evictions ensuring good governance and protection of the constitution.

In his letter, the directive goes thus; “No eviction shall be allowed to take place in a district without the consent and direct observation of the District Security Committee (DSC), chaired by the Resident District Commissioners/Resident City Commissioners (RDCs/RCCs) and direct consultation with the Minister of Lands.”

President Yoweri Museveni further warned that if this is not done and the evictions go ahead, the members of the District Security Committee shall all be held responsible.

The president, also in the same communication, requested His Lordship, Chief Justice Owiny Dollo, to prevail upon the Justices and Magistrates violating the constitution by illegally evicting people to help land grabbers.

He also directed the Minister of Lands to inform the Attorney General about such abuses through judicial officers so that legal action can be taken against them.
