UGANDA, Kampala Real Muloodi NewsA case has been opened up against Former Prime Minister Patrick Amama Mbabazi at the High Court of Uganda, Commercial Division in Kampala over allegations of failure to pay rent. 

The case was filed by Yonasani Kanyomozi against Mbabazi for alleged breach of their landlord-tenant agreement.

Amama Mbabazi was summoned by the Registrar of High Court, Flavia Nabakooza to file his defence concerning the allegations.

‘You are hereby required to file a defence in the said suit within 15 days from the date of service of these summons on you in the manner prescribed under Order 9 Rule 1 of the Civil Procedure Rules. Should you fail to file a defence on or before the date mentioned, the plaintiff may proceed with the suit and judgment given in your absence,’ the summons reads.

The Allegations

Through his lawyers M/s Anguria and Co. Advocates, Kanyomozi, the landlord, accuses Mbabazi of failure to pay four-month office rent arrears of Ush26,983,452 on Plot 29 in Nakasero, Kampala.

Kanyomozi also says that in 2015, Mbabazi rented the office space for his 2015/2016 presidential campaigns dabbed, ‘Go Forward.’

The tenancy agreement was made in 2015 where Mbabazi was required to pay a monthly rent of USD5000. He said that the tenant was required to pay for six months before occupying the premises, which he did.

However, after the lapse of the six months in December 2015, Mbabazi continued occupying the premises without fulfilling the terms of the tenancy agreement.

‘After the first deposit, the defendant started becoming uncooperative, avoiding the plaintiff and paying rent in insignificant fractions despite numerous demands and reminders from the plaintiff,’ reads the plaint instituting the suit.

Records before the court also show that by October 29th, 2021, Kanyomozi had only received USD39,992 (UGX 143,729,648) out of the USD47,500 (UGX 170,713, 100) he demands.

He also accuses Mbabazi of other breaches, such as failure to return duly signed copies of the Tenancy Agreement.

He further notes that Mbabazi has deliberately avoided responding to communication concerning the rent.

Kanyomozi claims to have sent out over seven reminders to Mbabazi for rent payments from 2016 until last year. He says his attempts to get written agreements signed by Mbabazi following the irregularities were futile, as he failed to get his response on the documents sent out.
