UGANDA, Wakiso | Real Muloodi News | Businessman Hamis Kiggundu has asked the Institute of Surveyors of Uganda (ISU) and the Surveyors Registration Board (SRB) to discipline Mr Bashir Juma Kizito, the surveyor for the Wakiso District, for allegedly having a conflict of interest.
Mr Kiggundu filed the complaint about Mr Kizito on September 19, 2022.
The Buganda Land Board (BLB) and Mr Kiggundu are in disagreement over the ownership of a 140-acre plot of land in Kigo, Wakiso District.
During the public hearing regarding the land in question before the commissioner of Land Registration in May, Mr Kizito allegedly presented himself as a district staff surveyor (a high government post), a representative of the Buganda Land Board, and an authorised attorney of the Kabaka (King) of Buganda.
“Wakiso District Land Board as a public office granted us permission to obtain freehold land titles over former public land. Currently, Bashir [Kizito] works as the district staff surveyor of Wakiso and has actual notice of our freehold land titles and truly participated in the process of their creation by checking and okaying the sub-divisions that happened on July 14, 2020,” reads the complaint.
According to Mr Kigundu, they learned that Mr Kizito wrote a survey report that BLB is using to try to have the freehold titles that he acquired through his company, Kiham Enterprises, revoked.
“To date, it is again Bashir Juma Kizito on top of the cancellation game of our freehold certificates of titles for our land situated in Kigo. This is a gross conflict of interest…, the very reason we are presenting him before the two bodies that govern professional and practicing surveyors in the country,” the complaint states.
Reaction
The Institute of Surveyors of Uganda confirmed receiving the complaint in a letter dated September 30.
“This case has been considered by the ISU disciplinary committee and decided that it is forwarded to the SRB for action as it involves a complaint concerning disciplinary action against a registered surveyor,” reads the response.
The newly established Surveyors Registration Board would handle the case, according to Mr Aloysius Gonza, vice president of the Institute of Surveyors of Uganda.
Mr Kizito declined to offer any comments on the subject.
“When matters are in court, we restrain from commenting until the court has pronounced itself,” he said.

In September, 2022, the Commissioner for Lands ordered for the cancellation of the four titles of Kigo land based on the report drafted by Bashir Juma Kizito. However, Mr Kizito’s report contradicted the findings of the comprehensive Joint Survey report made by the technical team commissioned by the tribunal, which concluded that the Freehold land titles are on public land.
Therefore, Kiham Enterprises Ltd through its lawyers: Muwema and Co. Advocates appealed to the Land division of the High Court against the decision of the Commissioner Land Registration and to stop the cancellation of its freehold titles.
The High Court granted an injunction last week prohibiting the commissioner for Land Registration from cancelling the four land titles belonging to Kiham Enterprises Ltd.
Mr Kiggundu claims that BLB ‘fraudsters’ spearheaded by Bashir Juma Kizito who were dissatisfied with the court’s decision, have since resorted to blackmailing him and assassinating his character.
According to Mr Kiggundu, the attacks began on November 10, 2022, on the Kingdom’s social media platforms, with false claims that he had sued the Kabaka, whereas Mr Kiggundu merely defended himself with an appeal against claims filed against him by Mr Kizito and BLB.
Mr Kiggundu says his attackers used the name of Kabaka alongside Ham’s Memorandum of Appeal in social media posts to give the illusion of credence to their false claims that he had sued Kabaka.
“My appeal against a decision to cancel his titles should not be mistaken for dragging Kabaka to court. BLB should desist from misusing the Name of Kabaka in pursuing their selfish interests”, says Mr Kiggundu.
