UGANDA, Kampala | Real Muloodi News | The High Court in Kampala has intervened, issuing an injunction to halt all charges against businessman Mohamed Kamoga of Kamoga Property Consultants.

The charges, comprising eight counts related to the alleged acquisition of a 200-acre land parcel in Wakiso District, were initiated by Peter Babigamba.

The accusations included forgery, uttering false documents, and obtaining registration through pretence, and were set to be heard at the Chief Magistrate’s court in Entebbe.

Facing these charges, Kamoga appealed to the High Court, contending that the proceedings amounted to the criminalisation of a land dispute, presenting an abuse of the court process.

Justice Isaac Muwata, presiding over the case, concurred with Kamoga’s argument, acknowledging that the dispute between Kamoga and Babigamba was the central focus across multiple court divisions.

Justice Muwata underscored that both the High Court and the Court of Appeal, where civil suits regarding the land dispute were pending, held jurisdiction to settle the rights of the parties involved.

Allowing simultaneous civil and criminal proceedings risked conflicting decisions, especially considering that the civil disputes already addressed land ownership and the legality of Kamoga’s actions.

The judge emphasised that the higher courts would determine the lawfulness of Kamoga’s transactions within the memorandum of understanding and the power of attorney with Babigamba.

Any identified illegalities would be addressed through the ongoing High Court proceedings, ensuring a comprehensive resolution within the established legal framework.

This intervention safeguards against potential conflicting outcomes and upholds the principles of justice in the ongoing dispute.
