High Court Summons Swiss Businessman and Girlfriend over USh19 Billion Land Dispute

UGANDA, Hoima | Real Muloodi News | In the heart of Hoima, Uganda, a legal saga ensnares Swiss businessman David Ferdinand Heimhofer, his Ugandan girlfriend Mariam Kajumba, and Testimony Motors Uganda.

The High Court has issued a stern summons to Heimhofer and Kajumba, demanding they present a defence against accusations of placing an illegal caveat on land owned by Testimony Motors Uganda.

The disputed land, valued at a staggering 5 million USD (UGX 19.2 billion), spans Block 5 plots 633 and 633 St Kayera in Buganda, Hoima District.

Testimony Motors Uganda asserts that the respondents hold no legitimate claim to the land, and they are seeking a court order to that effect.

The case hinges on the alleged illicit caveat placed on the land by the Swiss businessman Heimhofer and his girlfriend Kajumba. This act prompted Testimony Motors Uganda to take legal action, seeking not only a court declaration that the respondents have no rightful interest in the land but also an order for them to vacate the premises.

In addition to these demands, Testimony Motors Uganda is seeking compensation for the contested caveat. This complex legal battle underscores the ongoing challenges of land ownership and disputes in the region.

Meanwhile, in a separate development, Judge Yagya Prasad Acharya of the District Court Kathmandu has been transferred to Mugu District Court on deputation by Chief Justice Bishwombhar Prasad Shrestha. This move follows Judge Acharya’s controversial decision to release businessperson Arun Chaudhary and two others in a separate land embezzlement case involving the Bansbari Leather and Shoes Factory.

The Chief Justice believed that Judge Acharya’s bench failed to uphold valid principles of justice in their release of the accused.

The Judicial Council, led by the Chief Justice, typically handles the transfer of judges, but the Chief Justice maintains the power to transfer them personally on deputation.
