UGANDA, Kyambogo | Real Muloodi News | A whistleblower, identifying himself as Godfrey Deogratius Ouma, has formally petitioned the Inspectorate of Government (IGG) to launch an investigation into an alleged land fraud involving Principal Judge Flavian Zeija and Prof. Eli Katunguka Rwakishaya, the Vice Chancellor of Kyambogo University.

Ouma’s petition centres on the purported illegal consolidation of suits to acquire more than 80 acres of land on Kyambogo Hill, Nakawa Division, a suburb of Kampala, affecting 47 litigants and over 400 tenants.

The petitioner alleges that acting under the influence of the Vice Chancellor, the Principal Judge gathered various files with cases against Kyambogo University, assigned them to different Judges, and centralised them under another judge without notifying the involved parties and their respective lawyers.

Ouma contends that these actions violate Article 128 of the Constitution, which emphasises the independence of the judiciary, stating that “courts shall not be subject to the control of any person or authority.”

The petition, officially received by the Inspectorate of Government on December 21, 2023, includes a letter from the Principal Judge instructing the consolidation of different files.

Ouma has extended the complaint to the U.S. Department of State, the Organisation of Islamic Co-operation, the Islamic Development Bank, and the Judicial Service Commission, seeking sanctions against the accused for alleged abuse of authority and gross violation of the rights of affected litigants.

Ouma expressed disappointment over the reported refusal by Lady Justice Immaculate Busingye to consolidate specific cases, alleging that the file was transferred to a judge favoured by the Principal Judge.

He claims that one of the cases was inexplicably struck off the record.

The ownership of Plot M-902, measuring 160.260 hectares where Kyambogo University is situated, is reportedly under investigation by the Directorate of Criminal Investigations Department.

Ouma contends that individuals claiming the land, along with Kyambogo University, assert it is “Former Public Land,” a claim he disputes by referencing historical maps.

In response, Prof. Katunguka defended his letter to the Principal Judge, emphasising its intent to expedite case hearings due to reported encroachments on the land.

He asserted that his actions were those of the University’s CEO safeguarding against encroachers and denied any influence peddling.

At the time of reporting, neither the Principal Judge nor the Judiciary spokesperson had responded to inquiries.

The formal complaint and subsequent investigation highlight the complexities surrounding land disputes and legal processes, emphasising the need for transparency and adherence to legal protocols.

As the Kyambogo land fraud case unfolds, the Inspectorate of Government’s inquiry will shed light on the allegations, ensuring accountability and fairness in the administration of justice.
