UGANDA, Wakiso | Real Muloodi News | The Anti-Corruption Court summoned and charged Ms Resty Kiguli Nakayenga, the special presidential advisor for the underprivileged youth, with abuse of office and conspiracy to defraud. 

Ms Nakayenga, age 68, allegedly conspired with Mr James Batenda, age 32, a resident of Kungu-Lutale in Kyengera Town Council, to fraudulently acquire a title for 7 acres of land in Wakiso district.

The prosecution alleges that in 2018, while employed by the President at the Embassy House in Kampala District, Nakayenga abused the authority of her office and did an arbitrary act prejudicial to the interest of her employer. She fraudulently assisted Batenda in acquiring the Nakonge, Busiro land title. 

In the same year, at Wakiso District Land Office, it is accused Batenda fraudulently obtained a certificate of title for disputed land at Nakawuka Village. 

According to the charge sheet, Nakayenga and Batenda met at various places in Kampala and Wakiso districts to conspire and defraud another victim, Charles Kiku, of his land at Busiro.

They also allege that Nakayenga used her office as a presidential advisor to influence the Wakiso Lands Office to process a seven-acre land title at Nakawuka in Wakiso for James Batenda, who had only one acre in that area.

Nakayenga denies the charges against her. Batenda did not appear in court.

Nakayenga’s lawyer, Mr Peter Kimanja, asked the court not to send his client to jail, citing her ill-health and advanced age. 

Mr Kimanja also presented four sureties who he said had credentials and were ready to fulfil bail conditions. The sureties were Abbas Mukiibi, Mary Grace Nabbosa, Resty Nanziri and Sylvia Natongo. The Court bonded each of them at USh100 million.

Ms Sarah Namusobya, the Chief Magistrate, granted bail to the accused on that basis but ordered that she deposit USh6 million in cash. The court also  ordered Nakayenga to hand over her land title in Kyaliwajjala. The case was adjourned to November 17.

The court further issued criminal summons against James Batenda to appear in court on November 17.

The complainants had visited various lands offices seeking help, but their efforts were futile. Left with no other alternative, the victims reported their matter to the State House Anti-corruption Unit led by Col. Edith Nakalema, which intervened. The land has since been returned to the rightful owners.
