UGANDA, Kampala | Real Muloodi News | The Court of Appeal has temporarily halted the sale of properties owned by known business tycoon Haruna Ssentongo and his company, Haruna Enterprises, which are being pursued by Diamond Trust Bank Uganda and Diamond Trust Bank Kenya for recovery of over USh34 billion in loans.

The court issued a temporary injunction, delivered by Justice Oscar John Kihika, to stop the sale of Mr. Ssentongo’s properties pending the final disposal of the main case.

The properties in question include Block 12 Plots 538, 826, and 898 at Mengo.

Justice Kihika stated, “An order of a temporary injunction is hereby issued restraining [DTB Uganda and Kenya] … from selling the applicant’s interest and possession of the properties comprised in Block 12 Plots 538, 826, and 898 at Mengo until the determination of his appeal.”

The business tycoon Haruna Ssentongo and his company filed an appeal challenging the sale of his property and sought a temporary injunction to prevent the sale.

Justice Kihika noted that Mr Ssentongo has established a prima facie case pending determination before the court.

The court documents reveal that Mr Ssentongo and his company are indebted to the bank with an outstanding amount of USh9.8 billion due to DTB Uganda and $6.6 million (USh25 billion) due to DTB Kenya.

The disputed land was acquired by Mr. Ssentongo in 2014, and he spent about five years constructing a market named after his mother, Nakayiza.

Mr Ssentongo emphasised his sentimental attachment to the property and argued that he would suffer irreparable damage if the property was sold before his appeal was resolved.

Justice Kihika observed that Mr Ssentongo’s case was dismissed for failure to file a trial bundle within the stipulated timelines, and the applicant would face irreparable harm if his case was not heard on its merits.

The injunction will remain valid until the resolution of Mr. Ssentongo’s appeal, in which he challenges the dismissal of his case.
